Privacy Policy Statement and Risk Disclosures

Creating Capital Plc is committed to ensuring the confidentiality and security of your personal information. A copy of our privacy policy detailing how we handle your personal information is available on request.
Creating Capital Plc adhere to the Privacy Principles and seek to apply consistent privacy practices. Where you seek financial advice from one of our representatives, he/she will provide you with information on the privacy practices of that business. This Privacy Statement outlines how our Financial Advisors (United Capital Plc) and its company offices handle your personal information.
You may request access to information held by us about you, your investment portfolio and any other Financial Planning services which you may receive by contacting us on +(234)-1-280-8862.
In order to manage and administer our financial planning and advice services, it may be necessary for us to disclose your personal information to certain third parties. Unless you consent to this disclosure we may not be able to provide you with financial planning and advice services. The types of organizations to whom we may disclose your personal information include:
Financial institutions for the provision of financial products such as investments,pensions,life insurance
Your financial adviser for the purpose of managing your investments and financial products
Organizations undertaking compliance reviews of our financial advisors reviews of the accuracy and completeness of our information
Organizations providing mailing services, maintenance of our information technology systems and printing of our standard documents and correspondence.
We will only disclose your personal information to these organizations to enable them to undertake specified management and administration services. Creating Capital Plc will not disclose your information for any other purpose unless requested by you.
In some cases, it may be necessary to share your personal information with the various divisions of the business included within United Capital Plc (Our Wealth Advisors) and other departments i.e. financial control, and information technology or for the provision of financial services that you have selected.

Risk Disclosures


All investments come with the risk of diminution in the value of investment. Investing involves substantial risks which may be systematic, government policies, currency, inflation and general unfavorable economic indices. Past performance is not a guarantee of future performance. Certain types of investment may not be suitable for all investors. Investments, unlike savings and checking accounts, are not insured by the government against market losses. Different market instruments carry different types and degrees of risk and we advise you to familiarize yourself with the risk involved in such instruments you intend to invest in. The following list of risk factors is provided as an indication of the variety of the risks which may crystalize with investment with United Capital Private Wealth services. These risks are not extensive. In order to assist investors, risks have been grouped in different categories:

Market Risk

The unit value of shares and the income from them is subject to Market Risk i.e. Value can go down as well as up. You may not get back the amount invested. Past performance is not a guarantee to the future. When cancellation rights are applicable and you exercise them, you may not get back the full amount invested in the unit if share price falls between the initial investment and when we receive written confirmation that you wish to cancel the contract.

Foreign Exchange Risk

Changes in exchange rate could affect the value of your investments (in the case of overseas investment and/or dollar denominated investments). Movement in foreign exchange rates can impact on the level of income received and the capital value of the investment. For example, If a stock strengthens against the currency in which the underlying investments of the funds are made, the value of your holdings will reduce and vice versa.


Where the Manager’s periodic charges is to be taken from the income generated by the fund and there is insufficient income within the fund to meet the charge, client would be expected to execute a debit mandate to deduct due charges from the balance that will be deducted from the fund’s capital and to that extent, this will constrain capital growth. Where the Manager’s periodic charge is wholly taken out of the fund’s capital, distributable income will be increased at the extent of the capital, and to that extent, capital will be ended or future growth constrained

Important Notice

In a bid to assist the Federal Government of Nigeria battle the funding of terrorism and money laundering activities, the Money Laundering ( Prohibition) Act 2011 requires all financial and non-financial institutions to obtain, verify and record information that identifies each person who opens an account. In this regard, when you subscribe to a Financial Plan through our Wealth Advisors (United Capital), we will ask for an array of KYC information and verify your identity on an on-going basis.

In addition, in compliance with the Money Laundering (Prohibition) Act 2011, any single transaction, lodgment or transfer of funds in excess of N5, 000,000 or its equivalent in the case of an individual or N10, 000,000 or its equivalent in the case of a body corporate shall be reported in writing within 7 days to the Nigerian Financial Intelligence Unit (NFIU) and the Securities Exchange Commission (as applicable).

Designated Non- Financial Institutions Compliance

All Designated Non- Financial Institutions Compliance (DNFIs) are required , for regulation purposes, to register with The Special Control Unit against Money Laundering (SCUML) of Federal Ministry of Commerce, Nigeria in order to monitor their business transactions against money laundering.

DNFIs refer to:
Dealers in Jewelry, precious stones and metals
Dealers in cars and luxury goods
Audit firms
Tax Consultants
Clearing and settlement companies
Independent legal practitioners and chartered accountants
Trust and Company service providers
Real estate Agents
Non-Governmental Organizations
Religious and charitable organizations and such other business and professions as the Federal Ministry of Trade and Investments or appropriate regulatory authorities may from time to time designate

The above DNFIs customers include sole practitioners, partners and employed professionals within professional firms, they do not refer to “internal” professionals working for government agencies, who may already be subject to Anti Money Laundering/Counter Financing. NOTE: SCUML deals with such DNFIs that are incorporated entities (companies, business names, incorporate trustees etc): however individuals that practice or render such services in their personal capacity must also present themselves to SCUML for clearance.
